誠親王允禮等人在雍正十三年上奏,彙報他們翻查宗人府老檔案的結果。重點是康熙年間宗室諾尼被安親王嶽樂冤枉圈禁一案,後來在康熙三十九年得到平反恢復貝勒爵位,並追究了嶽樂的責任。這份奏摺就是把這些陳年舊案的來龍去脈整理清楚上報。
這是和碩果親王永理等人上的一道奏摺,他們是管宗人府事務的大臣。他們在查宗人府舊檔案時,發現一份關於康熙年間宗室諾尼的案子,現在把查到的東西詳細回奏。 我們宗人府的舊檔案裏記着,原來安親王嶽樂他們奏過一件事:康熙四年三月十二日,皇上降旨說,諾尼的母親和孩子還關在牢裏,他們的牛錄、壯丁、家產等該給誰,等王爺回來再議奏。查下來發現,諾尼的妻子沒罪,她丈夫本來就跟她不和、另外過,所以把她送回孃家,她帶來的人和東西都還給她。諾尼妻子生了一兒一女,妾生了六個兒子一個女兒。按規定,王爺以下的人犯事,如果兒子是跟着父親連坐,還沒分家的,就都處理;女兒因父罪被關的,不管許沒許人,父親升了跟着升,降了就跟着降。諾尼現在犯了大罪關在牢裏,他的孩子都從宗室除名,妻子生的兒子鄂漠和其他孩子一併處理。諾尼兒子生的那個妾,跟孩子留下。剩下的諾尼母親、孩子、牛錄下人、奴僕、錢財、衣服、家產,全交給敦郡王。諾尼的兒子諾蒙要不要也並過去,請皇上定奪。康熙四年六月初八日奏。十一日奉旨:諾尼的妻子不用回孃家了,讓他的孩子們養着。諾尼的孩子,按他妻子說的那份給了之外,諾尼的母親、孩子、牛錄下人、奴僕、家裏所有東西,平分給訥欽王和祿度貝勒。那兩筆收來的、典當的銀子,也由訥欽王和祿度貝勒還。諾尼的母親由訥欽王管飯,諾尼本人由祿度貝勒管飯。諾尼的兒女妻子都歸給祿度貝勒。另外,超出規定的東西不用交內務府,讓分到東西的人毀掉。其他照議定辦。這些都在檔案裏記着。 同年八月十四日又奏,問諾尼母親和孩子提到的紅批文書要不要交內務府。八月初十日奉旨:紅批文書交內務府,別單存,怕人亂翻。你們衙門的檔案照常記。也記檔了。 查諾尼當初犯事的緣由,檔案沒了。又查康熙三十九年的檔子,有宗人府左侍郎、輔國公兼都統布基等人奏報:根據紅本,敦郡王屬下包衣佐領諾尼跪請一事,康熙三十九年十二月十一日,大學士伊桑阿、馬齊交奏,奉旨:你們和原先議過的大臣們一起議後上奏。我們議了,諾尼跪請的文書說:“我姐原許給我姑的兒子畢力克。我姑不待見我姐,虐待她,我母親跟他們吵了幾次。我姐生孩子時讓睡涼炕,凍死了。我母親因此怨恨我姑不講理。我爲了報仇,娶了我姑的女兒爲妻,也折磨她、搞邪術,這屬實。因此結了仇。我姑求嶽樂,藉口沒給親王福晉穿禮服,嶽樂拿件沒影的事來問我。我生氣回說:我是我母親生的,難道你嶽樂沒母親嗎?哪來這種規矩!嶽樂罵了我一頓,把我趕出去,就不問了。嶽樂是因爲我姑求他,才怨我。我們母親就被他們設計陷害定罪,議政大臣們多次議奏,奉旨把我母親關進監牢。”後來皇上明察是冤枉的,把我母親從監裏放出來。我母親去世時,郡王福晉(姥姥)以禮發送。我父我母九泉之下也感受皇上大恩。我諾尼現在死也瞑目。只求皇上對嶽樂用沒影的事陷害我母親、冤枉害命的事,聖明裁斷。這案子本應把原審的人提來嚴審,但那些人大多不在了。原審的說法在理上也完全不通。諾尼的案子的確是冤枉的。而且諾尼母親去世時,皇上知道冤枉,以郡王姥姥禮發送。諾尼原先是貝勒,該給什麼名分,請旨。康熙三十九年十二月十二日奏。奉旨:交宗人府,和侍衛處內大臣們一起會議具奏。 我們會議:諾尼的案子確實很冤,諾尼母親去世時皇上用郡王姥姥禮發送。諾尼原貝勒,請仍爲貝勒。原審的宗人府官員違背事理、冤枉陷害人,都應查辦,但檔案都壞了,沒檔可查。而且諾尼告了安親王嶽樂,也該查辦嶽樂。因此奏請旨。十二月十四日奏,當天旨:照議辦。 我們又議:安郡王嶽樂作爲宗人府王,該公正審事,卻聽他妻子畢拉西氏和道里格格的話,接受格格請託,把諾尼母親冤枉定罪,實在不對。因此,把嶽樂追革親王,降爲郡王,他的衙門、旗分都歸閒散宗室。嶽樂的兒子安郡王瑪爾渾、愨郡王嶽希、固山貝子烏爾佔、輔國將軍兼副都統色布里,孫子輔國將軍色恆圖,全革職爲閒散宗室。還有給錫納海的格格、道里格格她們的額駙封號也都革去。他們所屬的佐領壯丁全抽回。查安郡王瑪爾渾是承襲他祖父阿巴泰的郡王,這王爵讓誰承襲,佐領壯丁給誰,由該管衙門請旨。等等。十二月十九日奏,二十一日旨:嶽樂追革親王,降爲郡王,衙門、旗分都按郡王等級。瑪爾渾承襲他祖父的郡王,從寬免革。嶽希的郡王、烏爾佔的貝子都革去,降爲公。色布里的輔國將軍和副都統、色恆圖的輔國將軍都從寬免革。遵旨記檔。 又查,貝勒諾尼在康熙四十四年正月病故後,衙門把他福晉生的兒子閒散宗室諾蒙、三等侍衛尹古爾德、輔國將軍兼頭等侍衛諾克託霍等人名列出來,請求承襲。同年四月二十五日請旨,閏四月初七日旨:讓南託霍爲輔國公豐格。都記了檔。 這案子最初的原因,因爲檔案壞了沒憑證可查,現在就按檔子裏還有的這些查出來,恭恭敬敬繕折詳細奏報。 嘉慶十三年十月十九日,總管事務和碩果親王臣永理,大學士臣〔?〕,宗人府左侍郎輔國公臣〔?〕等上奏。
總理事務宗人府事務和碩誠親王臣允禮等謹奏,為欽遵上諭、詳查具奏事。竊查臣衙門舊檔內載:和碩安親王臣嶽樂等奏稱,為請旨事,康熙四年三月十二日奉旨:Nonii之母及子,著交監圈禁,其佐領、戶口等項應如何給付之處,俟王到後議奏,欽此。欽遵查得,Nonii之妻並無罪過,其夫亦素不相合,應將Nonii之妻送回孃家,其帶歸之人並一切物件盡數給還。又Nonii妻所生一子一女、庶妻所生六子一女,酌定應給之處;查定例,王以下有罪者,因子連坐,若子未分居,則隨父圈禁,已嫁之女給與夫家,未嫁者父昇隨昇,降則隨降等語。今Nonii因犯重罪現監圈禁,所有子女俱著開出宗籍,妻所生子Omon,其餘子女一併交與;又Nonii之子所生庶妻一人,與其子留居。此外,Nonii之母、子、諸申、阿哈、財物、衣服、戶口一切等項,全行給與多羅平郡王;其Nonii之子Nomon應否歸併之處,請旨裁奪。等因,於康熙四年六月初八日具奏,本月十一日奉旨:其妻不必送回孃家,令其撫養子女,Nonii之子女除照妻所言給付外,Nonii之母、子、諸申、阿哈、家中一切物件,照例均分給平郡王勒克德渾貝勒,其二分取用、賒取、借貸銀兩,亦令平郡王勒克德渾貝勒等賠還。Nonii之母,著平郡王供給飯食;Nonii,著勒克德渾貝勒供給飯食。Nonii之子女妻室,俱交勒克德渾貝勒收管。再,除定例外多餘物件,免交總管內務府衙門,仍分給所得之人,其餘照所奏辦理,欽此。欽遵,載入檔案。同年八月十四日又奏,為請旨事:Nonii之母、子所稱紅字牌,應否交付內務府之處,請旨。等因,同年八月初十日具奏,本日奉旨:紅字牌交內務府,不得另行收貯,恐被私視,爾衙門照常記檔,欽此。欽遵,亦記檔訖。查原犯案情,無檔可稽;再查,康熙三十九年檔案內,宗人府左侍郎護國公兼都統臣布奇等謹奏:為叩閽事。廂紅旗平郡王所屬包衣佐領下Nonii叩閽一案,康熙三十九年十一月十一日,大學士伊桑阿、馬齊等交議具奏,奉旨:爾等與原議大臣等會議具奏,欽此。欽遵,臣等會議得,Nonii叩閽呈稱:我姐嫁與我姑之子Bilik,姑不慈愛我姐,屢加折磨,Nonii母親因此多次與姑爭論。我姐生產時,令臥冷炕,刑逼致死,我母氣憤,責罵我姑。我姑之女,我娶為妻,以報我姐之仇,亦加折磨,實有欺誑之事。由此結仇,我姑託嶽樂轉求,藉端正親王福晉未穿孝之隙,嶽樂將我誣以世間未有之事問罪,我對嶽樂說:我乃我母所生之子,豈有無母而此例者?忿怒回答,嶽樂將我逐出,再不問訊。嶽樂因受我姑轉求,責備於我,我母無辜,被誣陷加罪,屢次交部,致我母圈禁。聖主明鑑,將我母自圈所放出。近因我母亡故,郡王令照生母喪儀辦理,我父母九泉之下得沐主上重恩。Nonii我今雖死瞑目,但嶽樂誣我母以世無之事,冤抑陷害,擅殺情節,乞聖主明鑑裁奪。等語。此案應將原審人員提取,明白審擬,但原審之人似已無存,此案原審之言與情理甚屬乖謬,Nonii冤枉屬實。且Nonii母故,聖主明鑑,令郡王照母禮辦理。Nonii原係貝勒,應給何等之處,請旨裁定。等因,康熙三十九年十一月十二日具奏,奉旨:交宗人府,侍衛統領內大臣等會議具奏,欽此。欽遵,臣等會議得,Nonii之案甚為冤枉屬實,且Nonii母故,聖主明鑑冤抑,令郡王照母禮辦理。Nonii原係貝勒,仍應為貝勒。此案原審之言,宗人府之人乖謬誣陷,理應查參,但原檔損壞,現無檔案,且Nonii指控安王嶽樂,既經具控,應將原王嶽樂查議。為此謹奏請旨,康熙三十九年十一月十四日具奏,本日奉旨:照所奏辦理,欽此。欽遵,臣等會議得,原安郡王嶽樂理應公正審理宗人府王等事,乃因Birasii之妻禮儀格格轉求,將Nonii母委屈定罪,甚屬不合。因此,追革嶽樂親王,降為郡王,其衙署圈禁俱撤歸閑散宗室之列。嶽樂之子安郡王瑪爾渾、僖郡王嶽希、固山貝子吳爾佔、輔國將軍兼副都統色布里、孫護國將軍色亨圖等,俱行革退,為閑散宗室。其賜與Sinai之格格禮儀格格等額駙之號,亦行革除,其所屬諸申佐領俱行撤回。查得,安郡王瑪爾渾係承襲其祖阿巴泰之郡王,應將此王爵另襲,其諸申佐領應給與何人,請由該衙門請旨具奏。等因,康熙三十九年十一月十九日具奏,本月二十一日奉旨:嶽樂追革親王,降為郡王,其衙署圈禁俱照郡王等級。瑪爾渾既襲其祖郡王,從寬免其革退。嶽希之郡王、吳爾佔之貝子,俱革退,皆為公。色布里之輔國將軍、副都統,色亨圖之護國將軍,俱從寬免其革退,欽此。欽遵,亦記檔訖。再查,貝勒Nonii於康熙四十四年正月病故後,衙門將其福晉所生子閑散宗室Nomon、三等侍衛額古爾德、護軍統領一等侍衛訥克託等職名開列,奏請繼放何處,等因,四十四年四月二十五日請旨。閏四月初七日奉旨:Nantoho著為護國公封〔?〕,欽此。欽遵,俱記檔訖。再,此案原委因檔冊損壞,查覈無憑,謹就現存檔案查明摘出,繕摺敬謹奏聞。雍正十三年十月十九日,總理事務和碩誠親王臣允禮、協理〔?〕親王臣允祿、宗人府事務〔?〕〔?〕郡王臣雅〔?〕、左侍郎多羅貝勒臣〔?〕等。
A memorial jointly submitted by Prince Cheng of the First Rank, Yunli, and other ministers in charge of the general administration of the Imperial Clan Court, concerning the respectful compliance with an Imperial Edict and a detailed investigation. We humbly submit: Upon inspection, our office’s old archives record a memorial by Prince An of the First Rank, Yolo, and others, stating: “In compliance with an edict, we address the matter of disposition. On the twelfth day of the third month of the fourth year of the Kangxi reign, an edict was issued: ‘The mother and son of Noni are to be placed under custody and detained in prison. As to how his company and household property are to be assigned, wait until the princes arrive and memorialize after discussion. Respect this.’ In respectful compliance, we have investigated and found that Noni’s wife is without fault, and moreover she and her husband were never in harmony. It would be appropriate to send Noni’s wife back to her maiden home, and all her dowry belongings and persons she brought should be entirely returned. As for the one son and one daughter born to Noni’s wife, and the six sons and one daughter born to a concubine, the proper allocation should be determined. Looking at the statutes: for those below the rank of prince who incur crimes, if a son is implicated, and if that son has not yet established a separate household, he follows the father into confinement; a married daughter is given to her husband’s family, and an unmarried daughter rises when the father rises and falls when the father falls. Now Noni has been imprisoned for a serious crime, all his children are to be removed from the imperial lineage, except that the son Omon born of his wife is to be combined with the other children. Moreover, one concubine who bore a child of Noni is to remain with that child. Beyond this, Noni’s mother, children, bondservants, slaves, property, clothing, household effects and all other items are to be given entirely to Prince Ping of the Second Rank. As to whether Noni’s son Nomon should be placed together with them, we await an imperial decision.” This memorial was submitted on the eighth day of the sixth month of the fourth year of Kangxi. On the eleventh day of the same month, an edict was issued: “The wife need not be sent back to her maiden home; let her raise the children. Apart from what the wife has stated concerning the children of Noni, the mother, children, bondservants, slaves, and all household goods of Noni are to be divided equally between Prince Ping, Lekedehun Beile, according to precedent. The silver taken, borrowed on credit or on loan twice over shall also be repaid by Prince Ping, Lekedehun Beile, and others. Prince Ping is to supply food to Noni’s mother; Lekedehun Beile is to supply food to Noni. All of Noni’s children and his wife are to be placed under the custody of Lekedehun Beile. Furthermore, any excess items beyond the fixed quota are to be exempted from delivery to the Imperial Household Department, but shall still be distributed among those who received them. Execute the remainder as stated. Respect this.” In respectful compliance, this was entered into the archives. Again on the fourteenth day of the eighth month of the same year, another memorial was submitted, requesting an edict on whether the “red-character tablet” mentioned by Noni’s mother and children should be delivered to the Imperial Household Department. Submitted on the tenth day of the eighth month, on the same day an edict was issued: “The red-character tablet is to be delivered to the Imperial Household Department; it shall not be stored separately elsewhere, lest it be viewed improperly. Your office shall record it in the archives as usual. Respect this.” Complied with and recorded. When we sought the original case facts, no archives could be found for verification. Further inspection of the Kangxi thirty-nineth year archives reveals a memorial by Buki, Left Vice Minister of the Imperial Clan Court, concurrently a Prince Who Guards the State and a Bannerman Commander, and others, concerning a plaint lodged at the palace gate: A case in which Noni, under the commandery of Prince Ping of the Bordered Red Banner’s booi company, lodged a plaint at the palace gate. On the eleventh day of the eleventh month of the thirty-ninth year of Kangxi, Grand Secretaries Isangga, Maci, and others memorialized after referral. An edict was issued: “You together with the ministers who originally deliberated shall jointly discuss and memorialize. Respect this.” Having complied, we joint ministers have discussed and concluded: Noni’s plaint states: “My elder sister was married to Bilik, son of my paternal aunt. The aunt did not love my sister but constantly tormented her, so Noni’s mother disputed with the aunt many times. When my sister gave birth, they made her lie on a cold brick bed and tortured her to death. My mother, in anger, reproached my aunt. I then married my aunt’s daughter to avenge my sister, and also tormented her; indeed there was deceit. Thus enmity arose. My aunt asked Yolo to intercede, and under the pretext that the consort of Prince Duanzhong had not worn mourning, Yolo falsely accused me of an unheard‑of crime. When I replied to Yolo: ‘I am the son born of my mother; how can there be such a rule without a mother?’ he became angry and expelled me, without further inquiry. Because Yolo accepted my aunt’s intercession and reproached me, my innocent mother was falsely accused and implicated, was repeatedly sent to the Board, and finally imprisoned. The sagacious Emperor clearly discerned the truth and released my mother from prison. Recently, when my mother died, the Prince ordered the funeral rites appropriate for a birth mother. My parents below the Nine Springs received the Emperor’s great grace. Though I, Noni, now die, my eyes will close; yet Yolo falsely charged my mother with an unimaginable crime, unjustly framed and killed her. I beg the sagacious Emperor to clearly discern and decide.” This case should be tried by summoning the original examiners and clarifying matters; however, the original examiners seem to be no longer alive. The original trial’s words were extremely contrary to reason and principle, and Noni’s injustice is real. Moreover, when Noni’s mother died, the sagacious Emperor thoroughly perceived the injustice and ordered the Prince to administer the rites due a mother. Noni was originally a beile; as to what rank should be granted him, we await imperial decision. Memorialized on the twelfth day of the eleventh month of the thirty-ninth year of Kangxi. Edict: “Refer to the Imperial Clan Court and the chamberlains, the Inner Ministers, to jointly discuss and memorialize.” In compliance, we joint ministers discussed: The case of Noni is indeed a great injustice. Moreover, when Noni’s mother died, the sagacious Emperor, perceiving the wrong, ordered the Prince to administer the rites due a mother. Noni was originally a beile, so he should still be made a beile. The original trial’s statements, being contrary and framed by personnel of the Imperial Clan Court, should be investigated and impeached, but the original files are damaged and now unavailable. Since Noni has accused Prince An, Yolo, this prince should be investigated and deliberated upon. For this reason we respectfully memorialize and request an edict. Submitted on the fourteenth day of the eleventh month of the thirty-ninth year of Kangxi. On the same day, edict: “Execute as memorialized.” In compliance, we joint ministers discussed: Prince An of the First Rank, Yolo, should justly adjudicate matters of the princes, yet because he accepted the intercession of Birasi’s wife, Princess of Ceremonies, and unjustly convicted Noni’s mother, this was most improper. Therefore, Yolo is to be posthumously degraded from prince of the first rank to prince of the second rank, and his residence and compound are all to be removed and he is to be placed among the idle imperial clansmen. Yolo’s son, Prince An of the Second Rank Marhun, Prince Xi of the Second Rank Yohi, Beise Urjan of the Banner, General Who Assists the State and Assistant Commander Seburi, grandson General Who Guards the State Sehentu, etc., are all to be degraded and made idle imperial clansmen. Furthermore, the title of Prince Consort given to the Princess of Ceremonies who was bestowed on Sinai is also to be abolished, and all their Bondservant companies are to be withdrawn. Upon investigation, Prince An of the Second Rank Marhun inherited the princely rank of his grandfather Abatai; accordingly, this princely rank should be passed on to someone else, and as to whom the bondservant companies should be given, the relevant office should request an edict. Memorialized on the nineteenth day of the eleventh month of the thirty-ninth year of Kangxi. On the twenty-first day of the same month, an edict was issued: Yolo is to be posthumously degraded from prince of the first rank to prince of the second rank, and his residence and compounds are to be treated according to the rank of prince of the second rank. Marhun, having inherited his grandfather’s princely title, is to be pardoned from degradation. Yohi’s princely title and Urjan’s beise title are both to be abolished and they are to be made dukes. Seburi’s General Who Assists the State and Assistant Commander, and Sehentu’s General Who Guards the State, are both to be pardoned from degradation. Respect this. Complied with and recorded. Further investigation shows that after Beile Noni died of illness in the first month of the forty-fourth year of Kangxi, the office listed the names and ranks of his son borne by the consort, idle clansman Nomon, Imperial Guard of the Third Rank Egurde, Colonel of the Guards and Imperial Guard of the First Rank Noktoho, etc., and memorialized, requesting to whom the succession should be given. On the twenty-fifth day of the fourth month of the forty-fourth year, an edict was requested. On the seventh day of the intercalary fourth month, an edict was issued: “Let Nantoho be made Prince Who Guards the State with the title Feng _(?)_.” Respect this. All have been recorded. Moreover, because the files concerning the original circumstances of this case are damaged and no evidence can be found, we have respectfully extracted and compiled the information contained in the extant archives, written it into a folded memorial, and cautiously submit it for imperial information. On the nineteenth day of the tenth month of the thirteenth year of the Yongzheng reign, jointly memorialized by: Prince Cheng of the First Rank Yunli, in general charge of all affairs; Prince _(?)_ Yunlu, assisting in administration; Prince _(?)_ Ya _(?)_, handling affairs of the Imperial Clan Court; Beile of the Second Rank, Left Vice Minister, etc.
