刑部尚書兼理部務大臣、宗室覺格等人恭敬地上奏，請求皇上批示。 三陵內外所有事務總管、太子太傅、領侍衛內大臣蕭永道等人送來的文書裏說：馬蘭峪總兵官方士宜上報，稱他手下的中軍遊擊李東提交了一份報告。報告裏說，紹北巡山把總姜英科呈報：今年七月二十九那天，輪到巡山的時候，負責巡查中路的一名騎兵校尉和名叫才衛李的騎兵，親自來報告說，就在同一天，他們巡查到景陵前面的新東閣南邊時，碰見兩個正在偷割青草的傢伙，那割草的事是有證據的。我心想，這事發生在禁地，而且還沒到割草的時節，所以就追到東閣門口，抓住了一個。審問後得知，一個是太監李峯家的人，另一個逃跑了，也是太監李光福家的人。當時，駐紮在東閣的官方衙門裏，有個姓張的領催攔住他們說：“你們說這是太監李功家的人，那得拿出證據來。”就在那時，東閣裏湧出三四十人，強行把已經抓住的割草賊給搶走了。我琢磨着，已經抓住的犯人，怎敢讓他們隨意搶走、輕易放過？正打算去他主子那兒問問，沒想到李光福就站在東閣門外的井邊，立刻下令把東閣的門關上，不許我們答話。他還讓家裏的三四十人打我們，說着“打”，結果我們反而被抓起來捆住了。把總被打傷了右肩和右腳，傷勢很重，渾身都是被打的傷。佩帶的腰刀一把、布做的拱心鏡一副，都被搶走了。才衛李本人也被打得昏死過去，後來才緩過來，他佩帶的腰刀一把也被搶走了。打我們的時候，有個姓趙的太監攔住了東閣的門。還有小張太監、範太監，都在旁邊站着呢。因爲兩名被打的士兵都受了重傷，神志不清，而且動手的人太多，沒法一個一個認清楚。不過，那個喊着“打”並指使人的李姓太監，還有攔住門的趙姓太監，是可以作爲證人的。被打的事千真萬確，現在兩名士兵動彈不得，是死是活都難說。另外，趙姓太監還糾集家裏的奴才和無業遊民大約七十人，在路上堵截，在五塊橋東邊，把看守紅旗的騎兵校尉張貴宜抓進東閣，胡亂打了一頓，搶走了涼帽一頂、小毯子一條、馬褥子一個、褡褳一個，人被打得渾身是重傷。 方士宜我想，營區裏面，按理是士兵們巡邏查探的地方。現在他們違反禁令，私自割草，還聚衆把犯人搶走，毆打官兵，差點把人打死。這種種觸犯法令的事，事關重大，我不敢隱瞞不報。既然如此，我請求，或者呈報給總管內務府衙門，讓他們徹查割草的犯人並抓捕歸案，再查清私下毆打官兵的緣由，按律例定罪。爲此呈報。 看這情形，營區裏割草本來有固定的時間。這些人沒到時間就偷着割草，還聚集人手毆打巡邏的兵丁，實在是大大地違反了禁令。因此，我們已經把偷割草的犯人花色以及勾爾，一併移送到了你們刑部，請你們徹查審理。 等只把花色他們解送到部裏後，刑部就上奏了，開始審理。花色的口供說：“我是太監李層家的奴才。七月二十九那天，我跟老施、王宮太監家的勾爾，一起在新東閣南邊割青草。騎兵校尉才衛李跑過來抓我們，勾爾掙脫跑了，我被他抓住了。後來張姓領催跟把總他們說了話，就把我給放了。之後，把總他們又要來抓我們，李層不讓。太監李昆、黑趙、老施、王宮領着他們自己的一些家人，還有魏朱家的家人，就把把總他們給打了。之後，黑趙又領着家人，在五塊橋那個地方堵住騎兵校尉張貴宜，把他抓進東閣，胡亂打了一頓。我們那兒，壓根兒就沒有叫李峯、李光福的太監。領催阿爾納他們押送我們的路上，晚上在旅店住宿時，勾爾逃跑了。” 阿爾納的口供說：“我是正白旗巴泰佐領下的領催。太監李層他們怎麼打的把總等人，我不知道。八月初三那天，官衙門派出拜唐阿桑紹色、珠勒和我們三個人，押送花色和勾爾進京。走到薊州管轄的孝屯莊那個地方，晚上住店，我們睡熟了的空當兒，勾爾逃跑了。確實是這樣。”桑紹色和珠勒的口供，都跟阿爾納說的一樣。 經查，被打的兵丁把總等人說，他們是被李層等人聚衆指使毆打，還有其他動手的人，現在都在馬蘭峪那邊。兵丁把總等人的傷情非常嚴重，所以沒能把他們解送到部裏來。李層等人，把自己家的奴才隨意放出來，違反禁令偷割青草，被兵丁抓住後，又聚衆強行搶回，把兵丁們胡亂毆打，這嚴重觸犯了法律。這事牽涉到陵寢重地，至關重要。因此，請由部裏或各衙門，派出一名堂官，帶着花色以及讓勾爾逃跑的阿爾納等人，前往陵寢當地，會同領侍衛內大臣蕭永道等人，就近勘查，把李層等涉案人員嚴格審訊清楚，定罪後再上奏。等皇上下了聖旨，再把各個部門堂官的名字品級列出來，呈報上去，請皇上選派。 雍正元年八月十六那天，把這事交給了奏事郎中雙泉等人轉奏。當天就奉了聖旨：讓佛保住，帶着章京們，會同蕭永道，把這案子裏牽扯到的所有人，全部抓起來，嚴加審訊。太監，是我特意選派出來，隨同先帝的梓宮的。在梓宮還沒正式安放進地宮之前，他們竟然互相鬥毆，仗勢把官兵打成重傷，實在是大大地違犯了法令。務必要從重定罪，再奏報上來。欽此。 臣等恭敬地領旨後，便帶着我們部裏的郎中孫珠、主事昌尼，前往陵寢。從九月初二起，連日跟領侍衛內大臣蕭永道、尚書孫查齊一起會審。 審問花色說，你夥同勾爾，在景陵前面的新東閣禁地偷割青草，被巡山兵把總他們抓住了。當時有三四十人衝出來，把你給搶了回去。你的主子又指使三四十人，喊着“打”，把兵丁把總們捆起來毆打。把你搶回去，以及後來毆打兵丁把總的那三四十人，都是誰？姓什麼叫什麼？所有的事，你都得從實招來。 花色供稱：“我是薊州合河縣的民人，太監李層僱我來當差使喚。七月二十九那天，我跟王進玉太監家的勾爾，在新東閣那兒割草。被騎兵校尉才衛李看見了，追上來抓我們，說我們割了青草。勾爾掙脫跑了，我被抓住帶走。路上碰見領催阿爾納，他跟把總他們說了話，就把我放了。之後我就躲開了。後來聽說，把總他們去找我主子李層要人，兩邊爭吵起來。我當時不在那兒，不知道他們是怎麼打起來的。至於我被抓的時候，有三四十人衝出來把我搶走，這說法沒憑沒據。” 審問太監李層、李昆、老施王（即王進玉）、黑趙（即趙黑子）等人說，兵丁把總他們在景陵前面的新東閣禁地抓住了偷割青草的花色，你們帶着三四十人把花色搶回去，又指使三四十人把兵丁把總他們抓起來捆打，趙黑子還糾集了差不多七十人，在五塊橋那兒把兵丁張貴宜抓住毆打，搶走了他們的腰刀等物品。到底是怎麼個情況？是誰帶的頭、指使打的？一起動手打人的都是誰？姓什麼叫什麼？所有的事，統統從實招來。 李層供稱：“今年七月二十九，兵丁把總他們跑到我們住的營區裏，說我的家人花色在新東閣偷割草，把我喊出去，朝我嚷嚷着要人，還胡亂罵人。太監李昆看見了，去勸他們，他們不聽，連李昆也一塊兒亂罵。李昆就發火了，指使他家的家人喬爾、太監魏朱家的家人王三，喊着‘打’，就把把總他們給打了。確實是這樣。我自己絕對沒有動手。至於‘搶走花色’、‘三四十人毆打把總他們’這些說法，都是沒影兒的事。他們那些腰刀等物品是誰搶走的，我也不知道。” 李昆供稱：“七月二十九傍晚，兵丁把總他們跑來跟太監李層吵鬧，說他的家人花色割了草，讓趕快把人交出來。我出來再三地勸，把總他們不聽，連我也一塊兒亂罵。我就發火了，招呼我家的家人喬爾、太監魏朱家的家人王三，喊着‘打’，喬爾和王三就一起把把總他們胡亂打了一頓。確實是這樣。除了喬爾和王三之外，再沒有別人動手了。” 王進玉供稱：“七月二十九那天，我在景陵裏面值班。我家奴才勾爾，怎麼跟李層家的花色偷割草、怎麼毆打兵丁把總的事，我壓根兒不知道。我家的勾爾逃跑後，現在在哪兒，我也不知道。” 趙黑子供稱：“七月二十九傍晚，有兩個把總，我也不知姓什麼叫什麼，帶着二三十個兵，跑到我們住的營房裏來搜查人。我衝他們嚷嚷：‘你們憑啥，無緣無故闖進我們住的地方來搜查？’他們就用手指着我說：‘把他也算上！’就這麼個事兒。我絕對沒有糾集差不多七十人，在五塊橋那兒毆打兵丁張貴宜的事。” 審問喬爾、王三說，因爲李層家的花色在新東閣割草，兵丁把總們去抓人，李昆指使你們毆打了把總他們，還搶走了把總他們的腰刀、衣服等物品。這到底是怎麼回事？除了你們倆之外，還有誰動手打了人？都從實招來。 喬爾供稱：“我是太監李昆家的家人。七月二十九傍晚，我跟着主子李昆去喫飯，碰見騎兵校尉才衛李喝醉了酒，正爲着李層家的花色割了草的事，逼着李層交人，胡亂罵罵咧咧地吵鬧。我主子看見了，就勸他們。他們不聽，連我主子也一塊兒罵。我主子生氣了，說：‘打！’我就跟魏朱家的王三一起，把他們打了一頓。確實是這樣。我們絕對沒有搶走他們的腰刀等物品。除了我們倆，再沒有別人動手了。” 王三供稱：“我是太監魏朱家的家人。其他的事，都跟喬爾說的一樣。” 審問騎兵校尉才衛李說，你們在景陵前面巡山，抓住了偷割青草的花色。當時有三四十人衝出來，把花色搶了回去。太監李昆又指使三四十人，把你們抓起來捆打。到底是怎麼把你們抓起來打的？那三四十人都是誰？姓什麼叫什麼？搶走你們腰刀等物品的又是誰？ 把總供稱：“我是左營騎兵校尉。七月二十九那天，我跟騎兵才衛李一起巡山，走到景陵前面的新東閣那塊兒，看見花色和勾爾兩個人正在偷割青草。我們就追上去抓人，才衛李追到太監們住的營區跟前，抓住了花色。我隨後趕到，正查問的時候，領催阿爾納過來勸，花色就掙脫了。我倆就扯着阿爾納，讓他去找他主子李層要人。可李層不但不交人，反倒罵我們，就對吵起來了。這時候，太監李昆衝出來喊‘打’，於是他家的家人喬爾、魏朱家的家人王三、割草的花色和勾爾、領催額爾格家的奴才黑勒、僱工耶勒，還有好些個不知道姓名的人，總共有三十多個，就把我們倆抓住捆起來，打了一頓。打我們的時候，太監趙黑子正擋着門站着呢。後來，我又親眼看見趙黑子他們打了兵丁張貴宜。太監張進忠、范進朝在旁邊站着，他倆絕對沒有動手。張進忠把我佩帶的腰刀給拿走了。第二天，內務府的大人派人來查問，張進忠才從他屋裏把腰刀拿出來，還給了我們。現在，我被打的傷已經好了。” 才衛李供稱：“我是左營騎兵。七月二十九那天，我跟我們騎兵校尉把總一起巡山，走到景陵的新東閣那塊兒，看見這個花色和逃跑了的勾爾，正在偷割青草。我們就追上去抓人，勾爾掙脫跑了。我一直追到太監們住的營區跟前，抓住了花色，拿馬繮繩把他給捆了，正帶着走呢。領催阿爾納過來跟我說：‘這個花色是李層太監家的人，我認識他。這算多大的事兒啊，把他放了算了。回頭來領人的時候，你再跟我要。’ 正說着呢，周圍就圍上來三四十口子人。花色掙脫捆着的繮繩就給跑了。緊接着，我們騎兵校尉把總也追上來，跟我一起扯住阿爾納，讓他去跟他主子要人。阿爾納就領着我們，到了李層他們那兒要花色，兩邊就對吵起來了。這時，太監李昆衝出來，指使着衆人，把我們胡亂打了一頓。是誰把我佩帶的腰刀拿走了，我沒看清。後來第二天，從張進忠屋裏查出來，還給了我。現在，我被打的傷已經好了。” 審問張貴宜說，太監趙黑子夥同差不多七十個無業遊民，在五塊橋那兒堵住你，抓住就打。這到底是怎麼回事？那差不多七十個人，都姓什麼叫什麼？ 張貴宜供稱：“七月二十九那天，我在五塊橋東邊看守紅旗。傍晚去喫飯的時候，太監趙黑子領着好多人，把我從馬上拽下來。趙黑子狠勁抓着我，胡亂打了一頓。他家的家人伊柳，又從後邊揪着我的辮子，胡亂打了一頓。然後把我拖到新東閣，又打了一頓。伊柳搶走了我的涼帽一頂、小毯子一條、馬褥子一個、褡褳一個。那時候是有一羣人圍着，但都不認識，所以姓什麼叫什麼，全不知道。現在，我被打的傷已經好了。” 審問黑勒、耶勒說，你們夥同花色等人，毆打兵丁把總他們。到底是怎麼個情況？除了你們倆之外，還有那幫忙打人的三十多個人，都姓什麼叫什麼？現在都在哪兒？從實招來。 黑勒供稱：“我是鑲黃旗馬倫佐領下領催額爾格家的家人。花色他們是怎麼打的兵丁把總他們，我壓根兒不知道。我絕對沒有打過把總他們。” 耶勒供稱：“我是薊州孫花趙的民人，被鑲黃旗馬倫佐領下領催額爾格僱來幹力氣活兒的。我絕對沒有夥同花色他們，打過兵丁把總他們。” 審問太監張進忠、范進朝說，兵丁把總供稱，李昆他們指使着人毆打我們的時候，太監張進忠、范進朝就在旁邊站着。張進忠還把我佩帶的腰刀給拿走了。這話你們聽着了，這事兒到底是怎麼回事？ 張進忠供稱：“七月二十九傍晚，我從值班的地方回住處去喫飯，看見圍着一堆人在吵架。走近一看，是騎兵校尉才衛李正跟太監李層他們吵呢。我怕才衛李胡亂動手，就把他身上佩帶的腰刀拔下來，先收着了。後來，第二天，內務府大人那邊派人來查問，我就把那兩把腰刀都拿出來，還給他們了。我絕對沒有打過他們。” 范進朝供稱：“七月二十九那天，我值着‘羊牲’的班。傍晚，聽說太監們領着好多人，正在打那些兵丁。我就跑過去看，見騎兵把總在那兒躺着，才衛李站着。他們是怎麼打起來的，是誰打的把總他們，我沒看見。” 審問那姓張的領催，也就是阿爾納說，花色、勾爾他們在景陵前面的新東閣偷割草，兵丁把總他們抓住了花色，是你跟把總他們說了話，才把花色給放的。這到底是怎麼回事？ 正說着呢，衆人就圍上來了。花色是怎麼掙開捆着的繮繩逃跑的，我不知道。後來，把總追上來，跟才衛李一起扯住我，讓我交人。我就把他們領到李層他們住的營區去了。把總他們跟李層他們吵起來的時候，我看見趙黑子在營門口站着。後來，我就回值班的地方去了。他們是怎麼打起來的，我不知道。” 審問把總姜英科說，太監趙黑子供稱：“七月二十九傍晚，有兩個把總，領着二三十個兵，跑到我們住的營房裏來搜查人。我衝他們嚷嚷說：‘你們憑啥，無緣無故闖進我們住的地方來搜查？’他們就指着我說：‘把他也算上！’就這麼個事兒。我絕對沒有領着人，打過兵丁張貴宜。” 這話你聽着了，這又是怎麼回事？ 把總姜英科供稱：“我是右營把總。七月二十九那天，騎兵把總他們在新東閣抓住了偷割青草的犯人。因爲太監們聚衆，把把總他們打成了重傷，我聽見消息後，就跑去看。只見騎兵校尉才衛李、張貴宜都被打倒在地上躺着。我問了緣由，聽了太監李昆那番話：‘這些人跑到這兒來，胡作非爲地鬧事，所以我們纔打了他們。’ 於是，我就把騎兵校尉才衛李留在了那兒，把張貴宜先帶回來，報告了我們的總兵官。到了第二天，八月初一，報告了內務府衙門後，內務府的大人說：‘把打人者的名字查清楚帶來。’ 就派了官方的筆帖式達克塔、領催趙保，跟着我，帶着張貴宜，到李昆他們住的營房裏去查問過。確實如此。二十九那天，我絕對沒有帶着兵丁，闖進太監們打人的地方去搜查過人。” 審問喬爾、王三說，騎兵校尉才衛李供稱，李昆指使我們‘打’的時候，喬爾、王三、花色、勾爾、黑勒、耶勒，還有好些個不知道姓名的人，一共三十多個，把我們抓住捆起來打。這話說得很是明確。你們現在只說是你們兩個人打的把總他們，再沒有別人了，這樣狡辯行嗎？你們到底是怎麼夥同花色、勾爾、黑勒、耶勒他們，毆打把總他們的？除了你們倆之外，那幫忙打人的三十多人，都姓什麼叫什麼？現在都在哪兒？所有的事，統統從實招來。於是，就上了夾棍，拷問起來。 喬爾供稱：“我說實話罷。騎兵校尉才衛李亂罵我主子，我主子生氣了，說‘打’，我就和王三一起打的時候，花色、勾爾、黑勒、耶勒也幫着一塊兒打了。確實是這樣。我們絕對沒有把把總他們捆起來。除了我們倆，再沒有別的幫手了。要真有，我要是不供出來，難道還願意領受這重刑嗎？” 其他的話，還是跟先前說的一樣。 王三供稱：“我夥同花色、勾爾、黑勒、耶勒，一起打了騎兵校尉才衛李。確實是這樣。” 其他的事，都跟喬爾說的一樣。 審問花色、黑勒、耶勒說，騎兵校尉才衛李供稱，喬爾、王三、花色、勾爾、黑勒、耶勒，還有好些個不知道姓名的人，一共三十多個，把我抓住捆起來打。這話說得很是明確。現在喬爾、王三也供認你們跟着他們一起，打了把總他們。你們現在說絕對沒有打過把總他們，這樣狡辯行嗎？你們到底是怎麼夥同勾爾、喬爾、王三他們，把把總他們捆起來打的？除了你們之外，那幫忙打人的三十多人，都姓什麼叫什麼？現在都在哪兒？所有的事，統統從實招來。於是，一個一個地上了夾棍，拷問起來。 花色供稱：“那天，騎兵校尉才衛李追上來抓我們，勾爾掙脫跑了。才衛李抓住我，正捆着要帶走，領催阿爾納碰見了，跟才衛李說把我放了。正說着話呢，我就掙開捆着的繮繩，跑回住的營區去了。後來，把總他們來找我主子李層要人，兩邊就吵起來了。李昆喊着‘打’的時候，我就和勾爾、喬爾、王三、黑勒、耶勒一起，打了騎兵校尉才衛李。還看見趙黑子站在旁邊，打了張貴宜。我們絕對沒有把把總他們捆起來。除了我們幾個，也再沒有幫忙打人的人了。要是真有把把總他們捆起來，或者還有別的幫手，我要是不供出來，難道還願意領受這重刑嗎？” 黑勒、耶勒供稱：“太監李昆指使我們打騎兵校尉才衛李的時候，我們確實幫着打了。” 其他的事，都跟花色說的一樣。 審問李昆、李層說，兵丁把總他們供稱，我們去找李層要人，李昆指使喬爾、王三、花色、勾爾、黑勒、耶勒，把我們抓住捆起來打。這話說得很是明確。現在喬爾、王三、花色、勾爾、黑勒、耶勒，也都承認是李昆指使他們‘打’，所以他們就打了把總他們。你們這些人，是皇上特意選派出來，跟隨聖祖皇帝的梓宮的。在梓宮還沒正式安放進地宮之前，就隨心所欲，仗勢欺人，指使衆人毆打把總他們，這事兒千真萬確。你們現在還要狡辯，這能行嗎？除了喬爾等六個人之外，那三十多人，都是誰？姓什麼叫什麼？現在都在哪兒？所有的事，統統從實招來。於是，就把夾棍扔在地上，做出要用刑的樣子，審問起來。 李昆供稱：“那天，把總他們胡亂罵我，我生氣了，就喊着‘打’。我這麼一說，喬爾、王三、花色、勾爾、黑勒、耶勒他們就一起把把總他們給打了。確實是這樣。我們絕對沒有把把總他們捆起來。除了喬爾他們六個人之外，再沒有別的幫手了。要真有別的幫手，我自己指使人毆打把總他們的事，我都已經全認了，難道還不肯把他們供出來，替他們隱瞞嗎？” 其他的話，還是跟先前說的一樣。 李層供稱：“我跟把總他們爭吵的時候，李昆指使人喊着‘打’，於是喬爾、王三、花色、勾爾、黑勒、耶勒他們就一起把把總他們給打了。確實是這樣。” 其他的事，都跟李昆說的一樣。 審問趙黑子說，張貴宜供稱，趙黑子領着好多人，在五塊橋那兒把我從馬上拽下來，打了一頓。他家的家人伊柳，揪着我的辮子，拖着我走，又打了一頓。伊柳搶走了我的涼帽一頂、小毯子一條、馬褥子一個、褡褳一個。這話說得很是明確。而騎兵校尉才衛李也供稱，李昆、喬爾他們指使人打我們的時候，趙黑子就擋着門站着，他絕對沒有打我們。不過他親眼看見趙黑子他們打了張貴宜。你現在說，你絕對沒有領着人，在五塊橋那兒堵住張貴宜打；在打把總他們的時候，也壓根兒沒有擋着門站着。這前後矛盾。你到底是怎麼領着人，堵住張貴宜打的？那個伊柳現在在哪兒？除了伊柳之外，跟你一塊兒去打人的，都是誰？姓什麼叫什麼？所有的事，都從實招來。於是，就上了夾棍，審問起來。 趙黑子供稱：“李昆他們指使人打騎兵校尉才衛李的時候，我確實在那兒。但我絕對沒有擋着門站着。我家的家人伊柳，七月初三就進京城做買賣去了。我絕對沒有領着人，在五塊橋那兒堵住張貴宜打。” 其他的話，還是跟先前說的一樣。 審問騎兵校尉才衛李說，你們最初報案的時候說，抓住了偷割青草的花色，有三四十人衝出來，把花色搶了回去，勾爾的主人也指使三四十人打了你們。現在嚴審之下，太監李昆只供認指使喬爾、王三、花色、勾爾、黑勒、耶勒打了你們，絕對沒有別的幫手，而且咬定不改口。李昆他們帶着三四十人打你們的時候，難道還有別的看熱鬧的人嗎？ 把總供稱：“我和才衛李一起，看見花色、勾爾偷割草，就追上去抓人。勾爾掙脫跑了。才衛李追上去抓住了花色，碰見阿爾納，阿爾納正說着‘把花色放了’的時候，衆人就圍上來了。後來花色掙開捆着的繮繩逃跑，我們就去找他主子李層要人。李昆指使衆人，胡亂拉扯我們的時候，是有一羣人圍上來了。我當時心想，這大概都是來打我們的人。所以，就報告了我們的總兵官，報了案。確實是這樣。除了喬爾、王三、花色、勾爾、黑勒、耶勒之外，再沒看清打我的人，也確實沒有看見什麼看熱鬧的人。”
