刑部尚書塞爾圖等人上奏,向皇上請示一件事。事情是這樣的:原先戶部尚書哈芬,欠了十萬兩庫銀需要賠補。在追繳這筆銀子的時候,最開始由刑部尚書孫查齊,把哈芬的家人王五、來虎抓來,上夾棍嚇唬審問。他們供說,康熙四十九年,哈芬把三十六萬兩銀子轉移到他兒子恆肯家裏存着。後來,因爲這些銀子當中,有牽扯到蘇雲推、內倉等被參劾的案子,陸續交出了二十二萬五千兩,還剩十三萬五千兩銀子沒見動過。再嚴厲審問恆肯,他卻說,他爹哈芬只是在他這兒存了二十八萬兩銀子,除了那幾件被參劾的案子裏交出去的二十二萬兩,剩下的銀子,他爹在世的時候全拿走了,到底怎麼用的,他不知道。 接着,孫查齊又上奏參劾,把恆肯的官職給革了,然後和我們刑部一起會審。給恆肯上夾棍拷問,他還是那套供詞,只多說了一句,有別人告發他,還有兩萬三千六百兩銀子的事。又把恆肯的兒子劉新、家人來虎抓來上夾棍,還有哈芬的小老婆丁姐、王姐,恆肯的小老婆紅姐、春姐這些人,也都抓來嚇唬審問,她們都說不知道有多少銀子、藏在哪兒、託誰收着。 現在,孫查齊三番五次跟我們說,哈芬賠銀子這個事,他從今年六月開始跟我們刑部會審,所有情節都審遍了,唯獨被人告發的那筆銀子的去處,還沒審清楚。他寫了一份被告人的名單交給我們,讓我們把這些人傳喚來,他要接着審。我們查了一下,哈芬被人告發的那兩萬三千多兩銀子的事,早在康熙五十三年,哈芬本人就爲這事跪奏過,經我們把案子審明結案後,已經上奏了結了。我們把這話告訴孫查齊,他不幹,還是要審。 我們心想,這是早就奏明結案的事,如果又翻騰出來追究,我們沒有這個膽量。再說,哈芬應賠的庫銀有十萬兩,數目不小。因此,我們的意見是:把哈芬和恆肯的家產,交給他們所在的旗,先變賣充公;恆肯仍然關在牢裏,給他一年的限期,限期之內,他把隱匿起來的銀子交出來賠補完,就免了他的罪;如果補不完,就把他的老婆孩子一起發配到辛者庫當差;在這個期限裏,要是查出他隱匿銀子的線索,就按國法處置。 爲此,恭敬地寫這份奏摺,請皇上下旨。 這份奏摺,孫查齊也知情。 他本來……〔?〕 雍正二年十二月二十日 刑部尚書 額里金 左侍郎 (名殘缺)〔?〕 右侍郎 色楞額 右侍郎 德魁
刑部尚書臣色魯等謹奏,為請旨事。查得,前任戶部尚書哈芬應償十萬兩庫銀,於追繳之初,將前任工部尚書第五希芬之家奴王五來虎拘來,施以夾棍恫嚇訊問。據供:康熙四十九年,希芬將三十六萬兩銀移往其子恆肯家中存貯。嗣因蘇雲推內部倉廒事務被參等案,陸續交納其中銀兩,餘存二十二萬五千兩,其十三萬五千兩銀未見有何使用之處。嚴訊興安,據稱伊父希芬僅存二十八萬兩銀在其處,除因祖雲圖被參等案交納二十二萬餘兩外,其餘銀兩於伊父在日全行帶走,不知作何使用。續經參奏第五,將興安官職革除。臣等會同本部夾訊興安,仍照前供外,復稱被人舉發銀二萬三千六百兩。夾訊興安之子六新、家奴來虎等,並恫嚇興安之妾丁姐、王姐,及希芬之妾洪姐、春姐等,鹹供不知銀數若干、藏於何處、交誰收存。今第五屢向臣等言:哈芬還銀之事,我自本年六月與爾部會審完結,唯被人舉發銀兩之處未經審明,可將舉發人姓名書交臣等,飭傳到案審訊。臣等查希芬被人舉發之二萬三千餘兩銀,康熙五十三年希芬曾為此事跪奏,交臣部審明具奏完結。將此告知第五,第五不允,仍執意審訊。臣等伏思,此係早經奏結之案,若重翻再審,臣等實無此擔承。且希芬應賠庫銀十萬兩,為數非少。請將希芬及興安房產家業交該旗,先行查抄入官。興安仍行監禁,予以一年限期,限內將其所匿銀兩全數繳還,則寬免其罪;若不能完結,即將其妻子一併發往辛者庫為奴。限內若有隱匿情事發覺,按律治罪。為此謹奏請旨。(此奏已閱。第五原若有幹連〔?〕)雍正二年十二月二十日 刑部尚書臣額禮金 左侍郎臣花琫 右侍郎臣色楞額 右侍郎臣德魁
Memorial of Seru, Minister of Justice, and others, respectfully submitted, requesting an Imperial Decree. Upon investigation, when pursuing the 100,000 taels of treasury silver owed by Hafene, former Minister of Revenue, Wang U Laihū, a household slave of the fifth-ranking Hifene, former Minister of Works, was brought in, subjected to ankle presses, and intimidated for questioning. He stated: In the 49th year of the Kangxi reign, Hifene transferred 360,000 taels of silver to the home of his son HENGKEN for safekeeping. Subsequently, in connection with cases such as the impeachment regarding the internal warehouse affairs of Su Yūn Tui, part of this silver was delivered successively, leaving 225,000 taels, with 135,000 taels not seen to have been used at all. Under severe interrogation, Hinggan stated that his father Hifene had deposited only 280,000 taels with him; apart from the over 220,000 taels delivered in the Dzu Yūn Tu impeachment case and others, the remaining silver was taken away in its entirety by his father during his lifetime, and he did not know how it was used. Later, the fifth-ranking Hifene was impeached, and Hinggan’s official rank was stripped. We, your ministers, jointly tried Hinggan with ankle presses; in addition to repeating his previous testimony, he also stated that someone had disclosed 23,600 taels of silver. Hinggan’s son Liosin, his slave Laihū, and his concubines Ding Jiyei and Wang Jiyei, as well as Hifene’s concubines Hūng Jiyei and Cun Jiyei, were all intimidated and questioned; they all stated that they knew not how much silver there was, where it was hidden, or with whom it had been deposited. Now the fifth-ranking Hifene has repeatedly said to us: “As for the silver repayment by Hafene, I have concluded the trial jointly with your Board since the sixth month of this year; only the portion of silver disclosed by someone has not been clearly adjudicated. Write down the names of those who made the disclosure, hand them to us, and have them summoned for trial.” Upon inquiry, we find that the over 23,000 taels of silver disclosed by someone concerning Hifene was already settled: in the 53rd year of the Kangxi reign, Hifene knelt and submitted a memorial on this matter, which was assigned to our Board for thorough investigation; a memorial was submitted and the case was closed. When we informed the fifth-ranking Hifene of this, he was unwilling to accept it, still insisting on a trial. In our humble opinion, this is a case that was memorialized and concluded long ago; should we retry it, we would lack the audacity. Moreover, the 100,000 taels of treasury silver owed by Hifene is no small sum. We request that the houses and properties of Hifene and Hinggan be handed over to their respective banners for confiscation to the state treasury first. Hinggan should remain imprisoned, with a one-year deadline set; if within the period he surrenders all the hidden silver and repays in full, his crime may be pardoned. If he fails to repay, his wife and children shall all be sent to the Sin I Jeku (penal servitude) unit. If any hidden matters are discovered during this period, they shall be dealt with according to law. For this reason we respectfully memorialize and request an Imperial Decree.
